Comparative Constitutional Litigation

Guillaume Tusseau

Contemporary constitutionalism grants judges a considerable role. Guarantors of compliance with the highest standard, they ensure the proper functioning of public authorities and the protection of fundamental rights. The most heated political antagonisms, as well as the most complex ethical questions, now arise before them rather than before the traditional representative institutions.

This Treaty successively addresses the history of constitutional justice, the methodology on the comparative study of constitutional justice, constitutional magistracy, constitutional jurisdiction, constitutional disputes, constitutional procedure and constitutional decision. From Afghanistan to Zimbabwe via South Korea, Ecuador, the United States or the Czech Republic, this book offers the first comprehensive study of constitutional justice.

Covering nearly 200 constitutional justice systems, the study is unparalleled in scope. It is pioneering a combination of the realistic perspective of political jurisprudence and the technical perspective of procedural law. He thus sheds light on the power of judges in contemporary societies with unprecedented precision, while exploring the deep imagination to which constitutional justice is linked.

Unique in its kind, this book is thus intended for students, teachers, researchers in law and political science as well as practitioners of constitutional litigation, in particular lawyers and magistrates. It will also be of interest to citizens wishing to familiarize themselves with the contemporary constitutional state.
